JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Wagirganj P.S. Case No. 404 of 2018 registered for the offences punishable under Sections 147, 148, 149, 307, 427, 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR petitioner is said to have fired, causing injury to wife of the informant.

Submission of learned counsel for the petitioner is that there is land dispute between the parties and injury was found to be caused by hard and blunt substance. Heard learned APP, who has opposed the prayer for anticipatory bail stating that witnesses have supported the allegation of firing against the petitioner and injury was found to be grievous in nature.

Patna High Court CR. MISC. No.28334 of 2019(4) dt.22-10-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and at the same time the provisional bail granted to the petitioner by order dated 1.5.2019 is recalled. This application is, accordingly, dismissed.
