JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution case is that when the informant after collecting money was returning, four miscreants over took him by his two motorcycles and on the point of knife and Katta, they looted away his collected Rs. 18,000/- and two mobile phones. The informant claimed that the age of the miscreants were between 25 to 30 years.
Learned counsel for the petitioner submits that the petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that charge has been framed against the petitioner. He submits that similarly situated co-
Patna High Court CR. MISC. No.27846 of 2020(3) dt.14-12-2020 2/2 accused has been granted the privilege of bail by coordinate Bench of this Court in Cr. Misc. No. 85797 of 2019 on 04.06.2020. He submits that no TIP has been done in this case and he is languishing in judicial custody since 11.12.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st West Muzaffarpur in connection with Saraiya Police Station Case No. 566 of 2019.
