====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-10-2020 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is apprehending arrest in connection with Samho P.S.Case No. 24 of 2019 for the offence under Section 447, 342, 323, 307, 354, 504, 34 of the Indian Penal Code. Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.

The allegation against the petitioner is that he has assaulted the informant with lathi, rod and bricks. Learned counsel appearing on behalf of the informant submits that petitioner has concealed the fact that he is accused in five other cases.

Considering the affidavit on behalf of the petitioner that he has no criminal antecedent, the Court is inclined to

No.23436 of 2020(2) dt.13-10-2020 2/2 dispose of the petition with a direction to the court below to verify the record with regard to his criminal antecedent and if it is found that the petitioner was involved in any other case in addition to the present case, the court below shall refuse to release the petitioner otherwise, the court below shall release the petitioner on bail on furnishing bail bond of Rs.50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Begusarai in connection with G.R.No.1516 of 2019 arising out of Samho P.S.Case No.24 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C.
