ANJANA MISHRA ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Nautan P.S. Case no. 191/2015 registered for the offences punishable under Sections 467, 468, 471, 272, 273, 307 and 34 of the Indian Penal Code and 47A of Excise Act.

Learned counsel for the petitioner submits that so far as alleged recovery of currency notes is concerned, the petitioner has no concern whereas, in the second part of the FIR the allegation against the petitioner is that he was one of the persons found fleeing away from the place of occurrence where some liquor was alleged to have been recovered.

No.57547 of 2015 (2) dt.12-01-2016 2/2 conscious possession of this petitioner and that the only allegation is that he had been seen running away from the place of occurrence and that the petitioner is an accused in one other case, let the petitioner, above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. Shukla learned Judicial Magistrate Ist Class, Bettiah West Champaran in connection with Nautan P.S. Case No. 191/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
