The petitioner seeks bail in Shrinagar (Pujahan) P.S. case No. 16/2015 registered u/s 376/511/448 of the IPC and u/s 8 of the POCSO Act.

The learned counsel for the petitioner submits that petitioner was earlier granted bail vide order dated 14.07.2015 passed in Cr. Misc. No. 23841/2015 but thereafter the petitioner remained absent for 15 months. The petitioner had gone to earn his livelihood in another State that is why he could not personally appear in court although the petitioner had entrusted his pairvikar to do the needful during the course of trial.
