12-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Mushahari P.S. Case no. 41/2015 registered for the offences punishable under Sections 341, 323, 324, 326A, 354, 447, 504 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present prosecution case against the petitioner has been initiated only to wreck vengeance on him, as he was one of the Panches in dispute between one Ganga Sahni and the informant Kamli Devi. It is further submitted that the petitioner had participated in the Panchayati. The main allegation of throwing acid is not against the petitioner rather Ganga Sahni who has been since
Patna High Court Cr.Misc. No.57522 of 2015 (2) dt.12-01-2016 2/2 extended the privilege of regular bail.
Considering the afore-mentioned facts and circumstances the history of the dispute between the parties and that the petitioner has no criminal antecedent, let the petitioner, above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt Anupam Kumari learned Judicial Magistrate Ist Class, Muzaffarpur in connection with Mushahari P.S. Case No. 41/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
