The petitioner apprehends his arrest in connection with Punpun P.S. Case No. 97 of 2016, registered under Sections 363, 365 and 366 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Patna.

The accusation is that on 15.03.2016 the petitioner enticed away the wife and son aged about 4 years of the informant.

Learned counsel for the petitioner submits that petitioner is a painter and he has falsely been implicated in this case. Further submission is that there is no eye-witness of the enticing away the wife and son of the informant.

Patna High Court Cr.Misc. No.734 of 2017 (3) dt.28-02-2017 2/2 On the other hand, learned A.P.P. submits that it has come in paragraph 7, 8 and 9 of the case diary in which witnesses stated that petitioner used to accompany the wife and son of the informant in his absence.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
