The petitioner seeks regular bail in connection with Turkauliya (Banjaria) Police Station Case No. 340 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

This is the second attempt on behalf of the petitioner for grant of bail. Earlier, the prayer for bail of the petitioner was rejected by this Court, vide order, dated 18.02.2020, passed in Criminal Misc. No. 84447 of 2019, giving liberty to the petitioner to renew his prayer for bail after framing of charge.

Patna High Court CR. MISC. No.23770 of 2020(2) dt.17-09-2020 2/2 Learned Counsel for the petitioner, referring to paragraph 11 of this application and Annexure 3 to this application, submits that the charges have been framed against the petitioner on 18.02.2020, in Sessions Trial No. 108 of 2020. After having heard learned Counsel for the parties and taking into consideration the fact that charges against the petitioner have been framed on 18.02.2020, I am inclined to grant regular bail to the petitioner.

This application is allowed.

Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, at Motihari, in connection with Turkauliya (Banjaria) Police Station Case No. 340 of 2019. It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding lockdown and social distancing.
