Learned counsel appearing on behalf of the petitioner seeks to withdraw the present modification application filed for modification of order dated 30.09.2024 passed in CWJC No.13905 of 2013 (Anadi Kumar Singh Vs. The State of Bihar & Ors.), in view of the fact that the original petitioner, namely, Anadi Kumar Singh had died during the pendency of the writ petition but the said fact had not been

Patna High Court MJC No.1407 of 2025(3) dt.01-08-2025 2/2 brought on record nor any substitution petition had been filed for substitution of the legal representative of the original writ petitioner (deceased) and the petitioner of the present modification application claims to be wife of late Anadi Kumar Singh, as such, she becomes entitled to receive all the retiral benefits, as well as, pensionary benefit of the original writ petitioner.

3. The present modification application is dismissed as withdrawn with liberty to the petitioner to file a fresh writ petition for the relief(s) as prayed for in the present writ petition.

4. The present modification application is accordingly disposed of.
