2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 80 of BNS which was earlier rejected by learned coordinate Bench of this court vide order dated 14.05.2025 passed in Cr. Misc. No. 9915 of 2025
3. The case of the prosecution is that the marriage of the daughter of informant was solemnized with the petitioner on 22.05.2023. It is alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand. It is alleged that the petitioner along with other have strangulated his wife on 07.11.2025.
4. Learned counsel for the petitioner submits that the

Learned counsel for the petitioner has submitted that from the perusal of the status report the learned trail court, it will transpire that till today only one witness has been examined on merit. He has further been submitted that from the perusal of the inquest report, it will transpire that police has alighted the deceased from the place where she was hanging and from perusal of the postmortem report also, it will transpire that doctor conducting autopsy of the deceased found following ante-mortem injuries: ligature mark " 21⁄2 cm to 31⁄2 cm in width were present in upper part of neck between chin and thyroid cartilage.
It was running upward and backward encircling all around neck except left lateral side of neck where it was discontinued. Ligature Mark was abraded and parchmantized. Doctor conducting autopsy has opined that the cause of death was due to asphyxia as a result of hanging. Learned counsel for the petitioner has submitted that save and except the ligature mark no any injury on any part of the body of the deceased was found during postmortem and as per the inquest report also it is clear that the police itself has alighted the deceased from the fan where she was hanging. It has further been submitted that it is clear cut case of hanging.
Patna High Court CR. MISC. No.27706 of 2026(3) dt.22-06-2026 3/3 petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 08.11.2024.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kudhani P.S. Case No. 212 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge17th, Muzaffarpur.
