JUSTICE RAJIV ROY ORAL ORDER 01-02-2023 In this case, so far as the petitioner no.2 Prabhu Sahu is concerned, the prayer for anticipatory bail was withdrawn which has been recorded by the coordinate bench vide an order dated 08.08.2022.
Heard learned counsel for the parties.
The petitioner apprehends his arrest in connection with Rahika P.S. Case No.165 of 2021 instituted under Sections 341,452,376,120B and 506 of the Indian Penal Code. As per the prosecution story, the lady alleged that while she was sleeping in her house and her husband was in the shop in the evening of 'Durga Pooja', the petitioner no.1 came and entered her house and after closing her mouth forcibly tried to rape her. She however managed to come out of the room,
Patna High Court CR. MISC. No.28120 of 2022(4) dt.01-02-2023 2/2 locked the same and thereafter called her family members and when the door was reopened he was caught lying under the bed on the floor.
The kind of allegation that has come against the petitioner in the present case, which has been endorsed by the lady under Section 164 of the Cr.P.C., certainly this is not a fit case for extending anticipatory bail, which is accordingly rejected.
