In this case, the petitioner is seeking anticipatory bail in connection with Jamui P.S. Case No.70 of 2017, registered for the offence punishable under Sections 366 and 34 of the Indian Penal Code.

Allegation against the co-accused including the petitioner is to have kidnapped the minor daughter of the informant with an intention to perform the marriage. Counsel for the petitioner submits that he is elder brother of co-accused Manish Kumar, who is said to have kidnapped the girl. The petitioner is Electrical Engineer posted at Barma country and on the alleged date of occurrence, he was

Patna High Court CR. MISC. No.28278 of 2019(2) dt.30-04-2019 2/2 present in Barma Country. It is urged that father of the petitioner has already been granted bail.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
