The petitioner seeks bail in connection with Ara Nawadah P.S. Case No. 504 of 2018 registered for the offence punishable under Sections 302/307/34 of the Indian Penal Code and 27 of the Arms Act.
The petitioner is in custody since 02.09.2018 Considering the fact that only material against the petitioner and others is confessional statement of co-accused Ravi Ranjan Pandey before the police, while in police custody, as well as considering the fact that the other co-accused have been granted by the Coordinate Benches of this Court vide in Cr. Misc. No. 75563 of 2018 dated 16.01.2019 and Cr. Misc. No. 15706 of 2019 dated 21.06.2019, let the petitioner, above
Patna High Court CR. MISC. No.27721 of 2019(4) dt.28-06-2019 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Ara Nawadah P.S. Case No. 504 of 2018 to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, subject to the following conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Anjani Kumar Sharan, J) amitkumar/- U T
