Since, the Appeal Case No.

521110115111907001/2A is pending before the Second Appellate Authority-cum-District Magistrate, Khagaria but there

Patna High Court CWJC No.6451 of 2024(2) dt.15-04-2024 2/2 is no chance of hearing of the appeal in the near future because of ensuing election.

3. In these circumstances, this application is disposed of with a direction to the respondent authorities that during pendency of the appeal before the District Magistrate, Khagaria, the structure of the petitioner shall not be demolished.

4. It is also directed that during the hearing of the appeal, the District Magistrate, Khagaria will also consider the statement of the petitioner made in the writ petition.

5. With the aforesaid direction, this application is disposed of.
