The petitioner apprehends his arrest in connection with a case under Section 304B of the Indian Penal Code. The informant alleged that her daughter was married with Suraj Ram (the petitioner) but her husband and other in-laws began to torture her. Her daughter was pregnant. It is alleged that her son-in-law informed about the illness of her daughter but when she went to Dehri, her daughter was dead. It is submitted that the wife of the petitioner was pregnant and died due to septicemia caused due to death of still-born baby in the foetus and not on account of ill-treatment. The allegation of the demand of dowry and torture is an afterthought.
Considering the fact that from perusal of the post-
Patna High Court Cr.Misc. No.35980 of 2015 (4) dt.21-12-2015 P2/2 mortem report, it appears that the deceased-wife of the petitioner died on account of death of still-born baby in the foetus on account of which septicemia developed, the petitioner above named in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas in Nasriganj P.S. Case No. 120 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J) Saif/- U T
