The petitioner seeks bail in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 577 of 2021 corresponding to POCSO Case No. 51 of 2022 registered for the offence under Sections 363, 366(A), 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case and the matter has already been settled.

In view of the submission of the learned counsel for the petitioner, this application is disposed of with a direction to the trial Court to consider the bail application of the petitioner after the victim is examined.

Patna High Court CR. MISC. No.28288 of 2023(2) dt.24-05-2023 2/2 If the victim does not support the prosecution case or turns hostile then the petitioner shall be released on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount.

If the victim supports the prosecution case then the bail application shall be considered by the trial Court in accordance with law.

With the aforesaid observations and directions, this application is disposed of.
