The appellants seek pre-arrest bail in connection with Dehri SC/ST P.S. Case No. 23 of 2019 registered under Sections 147, 148, 341, 324, 427, 504, 506, 34 of the Indian Penal Code and Section 3(i) (r) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Submission of learned counsel for the appellants

Patna High Court CR. APP (SJ) No.1608 of 2019 dt.21-05-2019 2/2 is that the appellants have falsely been implicated in the present case due to personal grudge with ulterior motive. They are innocent. Further submission is that there is case and counter case for the alleged occurrence. Further submission is that the injury is found simple in nature. Having heard both sides and in the facts and circumstances of the case, let the above named appellants be released on bail, in the event of arrest or surrender, on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cumSpecial Judge, SC/ST Act, Rohtas at Sasaram in connection with Dehri SC/ST P.S. Case No. 23 of 2019, subject to the conditions as laid down under section 438(2) of Cr. P.C. Accordingly, the appeal is allowed and the impugned order is set aside.
