1. Heard learned counsel for the petitioner and learned AC to SC-9.

2. The learned State counsel at the outset submits that from perusal of the pleadings made in the writ application, it would manifest that petitioner has also filed Title Suit No.1139/2024 in the Court of learned Sub-Judge-1, Saran at Chapra for declaring his title over the land, on which the learned counsel appearing on behalf of the petitioner submits that the land in dispute in the instant writ application pertains to MauzaParsadi, Thana No.474, Tauzi No.3400, Khata No. Topo, Khesra No.Topo, Area-10 Katha 12 dhur, District-Saran. It is further submitted that the petitioner is in possession of the land in

Patna High Court CWJC No.7645 of 2025(2) dt.26-06-2025 2/2 dispute in the instant writ application since 1946 but then the Circle Officer was forcibly trying to dispossess the petitioner as such after issuing notice under section 80 CPC the aforesaid title suit was filed but then the State authorities are not appearing in the suit despite notice being issued, on which the learned State counsel submits that now it has come to the knowledge of the authorities through this writ application that aforesaid title suit is pending adjudication as such the same will also be communicated to the District Magistrate, Saran.

3. At this stage, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the writ application with liberty to pursue his remedy before the learned District Court.
