JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2018 The petitioner is apprehending his arrest in connection with Mairwa P.S. Case No. 76 of 2017, registered for offences punishable under Sections 413, 414/34 of the Indian Penal Code. Petitioner is named in F.I.R and allegation against the petitioner and others is of committing theft of motorcycle and sale of the theft motorcycle.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and his name has been disclosed by the co-accused of this case and nothing has been recovered from the possession of the petitioner. Heard learned A.P.P. also. He has opposed the prayer for bail.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.11404 of 2018 (3) dt.03-04-2018 2/2 circumstances of the case, nature of allegation, I am not inclined to grant the petitioner, the privilege of anticipatory bail. This application is, accordingly, dismissed.
