JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner seeks bail in connection with Excise P.S. Case No. 240 of 2023 registered for the offence Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 03.03.2023 and there is recovery of 180 litres liquor from his possession.

Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released after

Patna High Court CR. MISC. No.28199 of 2023(2) dt.15-05-2023 2/2 completing six months in custody on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-IV-cum- Special Excise Court No. 2, Gopalganj in connection with Excise P.S. Case No. 240 of 2023. The petitioner will visit Manjhagarh Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
