====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Kadirganj P.S. Case No. 273 of 2024 in a case registered for the offence punishable under Sections 111(2)(b), 111(3) and 111(4) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, total 2583 litres of foreign liquor has been recovered from a truck, pick-up van and motorcycle and this petitioner is alleged to have fled away along with other co-accused persons from the spot.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of

Patna High Court CR. MISC. No.28146 of 2025(2) dt.04-07-2025 2/2 the petitioner. Petitioner is in custody since 18.03.2025 and charge-sheet has been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court, Excise-I, Nawada in connection with Kadirganj P.S. Case No. 273 of 2024.
