The petitioner apprehends his arrest in Special case No. 36/2017 corresponding to Mahila P.S. case No. 62 of 2017 for the offences punishable under Section 376/34 of the Indian Penal Code and under Section 3⁄4 of POCSO Act.

The learned counsel for the petitioner submits that petitioner has already solemnized marriage with the informant and the informant got a child. The informant is living with the petitioner.

The informant is present in court along with her counsel and states that she is living with her husband. Considering the facts aforesaid and the nature of

No.17754 of 2018 (4) dt.18-04-2018 2/2 allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge -cum-Special Judge, POCSO, Araria in connection with Special case No. 36/2017 corresponding to Mahila P.S. case No. 62 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
