The petitioner seeks privilege of pre-arrest bail in connection with Barachatti P.S. Case no. 474 of 2016, registered under Sections 272, 273 and 120(B) of the Indian Penal Code and Section 30(A), 32(ii), 38 and 47 of the Bihar Excise (Amendment) Act, 2016, pending in the Court of Chief Judicial Magistrate, Gaya. In view of the order dated 07.07.2017 passed in Criminal Misc. No.26109 of 2017 by a Bench of this Court, this application, under Section 438 of the Code of Criminal Procedure, would not be maintainable.

Accordingly, this application stands dismissed being not maintainable.
