The petitioner seeks pre-arrest bail in connection with Piro P.S. Case No. 95 of 2015 registered under Sections 323, 341, 307, 504 read with 34 of the Indian Penal Code and 3(1)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.

It has been contended that from perusal of the FIR itself, it would appear that the specific allegation for the offence punishable under Section 3(1)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act is confined

Patna High Court Cr.Misc. No.728 of 2016 (2) dt.12-01-2016 2 / 2 against co-accused Sanjay Singh and Upendra Singh and so far as the petitioner is concerned, he being a young boy of 19 years, is simply alleged to have scuffled with the son of the informant. It is further contended that it would be evident from the impugned order itself that the injuries sustained by the two members of the prosecution party are all simple in nature. Learned Special Public Prosecutor for the State has opposed the application filed on behalf of the petitioner for grant of anticipatory bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhojpur at Ara in connection with Piro P.S. Case No. 95 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
