The counter-affidavit has been filed on behalf of the State on 20.07.2009 after serving a copy upon learned counsel for the petitioner and no reply thereto has been filed. In the counter affidavit, it is stated that the entire selection process was held in accordance with law and thereafter a merit panel was prepared but the name of the petitioner did not find place in the said panel and accordingly, the appointments have been made strictly in terms of the said merit panel.

In the aforesaid circumstances, the writ application is dismissed as not pressed.
