1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 317(2),303(2),3(5) of the B.N.S., Sections 11(1)(a),11(1)(d),11(1)(e),11(1)(i),11(1)(k) of the Prevention of Cruelty of Animal Act, Sections 47(a),48,54(1) of the Animal Transporting Act, 1978 and Section 4(a) of the Punjab Cow Slaughter Prohibition Act, 1955.

3. The learned counsel for the petitioner submits that the petitioner is in custody since 27.12.2024, he is a person with clean antecedent and allegation is of transporting ill and incapable cattle in a pick-up van.

4. The learned counsel for the petitioner submits that petitioner is the driver of the vehicle in which the cattle were

It is also submitted that charge-sheet has been submitted and petitioner will cooperate in the trial to prove his innocence.

5. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the bail application.

Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Bihta P. S. Case No.1179 of 2024.

7. The application stands allowed.

8. However, it is made clear that if the learned trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial Court shall be at liberty to cancel the bail bonds of the petitioner after recording reasons.
