2. The petitioners are apprehending their arrest in connection with Rajapakar P.S. Case No. 441 of 2025, registered for the offences punishable under Sections 80/3(5) of the BNS.
3. The marriage of the sister of the informant was solemnized with the son of the petitioners on 28.11.2023. Despite sufficient dowry extended at the time of marriage, the accused persons were kept on demanding dowry as well as motorcycle but when the same was not fulfilled, the accused persons in collusion with each other killed the deceased by

4.Learned Advocate for the petitioners submitted that the petitioners are parents-in-law and save and except the omnibus allegation, no accusation of any overt act has been attributed. During the course of investigation, statements of the neighbours were recorded who have categorically stated that on the fateful day on account of some altercation between the family members, the deceased had committed suicide on a fit of rage. The aforesaid fact also stands corroborated with the inquest as well as the postmortem report which clearly suggest that it was a case of suicide by hanging. There was no mark of any external injury over the body of the deceased and as such the allegation of any assault and causing death of the deceased does not arise. The petitioners have no concern with the day to day affairs of the husband and the wife and now they undertake that they will fully cooperate in the proceeding of the court.

On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that deceased died within three years of her marriage and there is a specific allegation that prior to her death, a demand for dowry had been made and, as such, the dowry death cannot be ruled out.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of statement of the independent witnesses duly recorded by the Investigating Officer in course of investigation, besides the postmortem report which clearly suggests that it was a case of suicide by hanging and there was no mark of any external injury, coupled with the fact that the husband is behind bars and the petitioners are none else but the parents-in-law, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 441 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
