The petitioner is apprehending his arrest in connection with C2A-26 of 2014, registered for offences punishable under Sections 47 (A) & (F) of Excise Act.
Allegation is of recovery of 1620 liters of country made liquor and 8,000 K.G. of unprepared wine from the field of petitioner.
It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner rather the recovery was made from an open field, which a joint property and petitioner has nothing to do with the said recovery and has falsely been made accused in this case. Further
Patna High Court Cr.Misc. No.30811 of 2018 (2) dt.04-06-2018 2/2 he has no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with C2A-26 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
