The petitioner seeks regular bail in connection with Rautara Police Station Case No. 24 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation against the petitioner, as per the First Information Report, is that when the informant was going on his motorcycle and reached near the culvert, he was intercepted by a person, who stopped his motorcycle and two persons came from the bamboo clump. It has further been alleged that the accused persons snatched the motorcycle of the informant on gun point and the two persons forced the informant to sit on the motorcycle and they brought him in the bamboo clump and

Patna High Court CR. MISC. No.23592 of 2020(2) dt.17-09-2020 2/3 assaulted him, abused him, snatched his mobile and the petitioner was identified by the informant at the time of occurrence.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to village politics. He further submits that nothing has been recovered from the possession of the petitioner and the motorcycle, which was alleged to have been snatched by the petitioner and other accused persons, was found lying in a field.

Having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 21.03.2020, I am inclined to grant regular bail to the petitioner.

This application is allowed.

Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Rautara Police Station Case No. 24 of 2020.
