The petitioner apprehends his arrest in Dehri (Indrapuri) P.S. Case No. 481 of 2017 under Sections 302, 307 and other sections of the Indian Penal Code.

The informant, Tara Devi, alleged that at about 03.00 a.m. in the morning she woke up and found Rahul Kumar @ Kallu, Raja Kumar @ Mallu, the petitioner, Bhim Kumar Singh @ Ajay Kumar Singh standing in her court-yard. They were armed with dagger. The accused persons assaulted the informant with dagger. When Mansa Kumari, the daughter of the informant, came to save her, all the three persons inflicted dagger blow. The daughter of the informant died.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case on account of previous enmity, but, it appears that the informant made specific allegation that the petitioner and two other accused persons inflicted dagger blows to the informant and her daughter and the daughter of the informant succumbed to the injuries. Considering the fact, aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail.
