The petitioner apprehends his arrest in connection with Fulwari Sharif (Janipur) P.S. Case No. 631 of 2016, registered under Sections 341, 323 and 498(A)/34 of the Indian Penal Code and Section 3/4 Dowry Prohibition Act, pending in the court of the Judicial Magistrate, 1st Class, Patna. The accusation is of torturing of the complainant Soni Kumari by her husband and other in-laws due to nonfulfillment of demand of dowry and also removing her from her matrimonial house after snatching her personal belongs. Learned counsel for the petitioner submits that while
Patna High Court Cr.Misc. No.17785 of 2017 (5) dt.31-07-2017 2/2 the matter was referred to the Mediation Centre for settlement of dispute, but in spite of best and sincere efforts, the dispute could not be settled.
On the other hand, learned counsel appearing on behalf of O.P. No.2 submits that O.P. No.2 is ready to go with the petitioner and live her conjugal life, but petitioner is adamant not to take the informant as his wife.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. (Rajendra Kumar Mishra, J) manish/- U T
