JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in Bind P.S. Case No.96 of 2016 registered under Sections 304(B) and 201/34 of the I.P.C.

The accusation is that the marriage of the deceased Resham Kumari who happens to be the sister of the informant was solemnized with Manish Kumar in the year 2013. In spite of giving Rs.2.50 lacs as well as ornaments, utencils etc. at the time of marriage Rs.50,000/- was being demanded from her when she showed inability to fulfill the demand she was brutally beaten and threatened with dire consequence by her in-laws. In the meantime she was blessed with a son out of the wed lock. On 16.08.2016 the informant received information to the effect that his sister has

Patna High Court Cr.Misc. No.52850 of 2016 (3) dt.15-12-2016 2/2 been burnt to death and her dead body has been disposed of then, he rushed to the matrimonial house of his sister where he found the floor of the house well cleaned and smell of phenyl and kerosene oil.

Learned counsel for the petitioner submits that the petitioner is brother-in-law of the deceased and no specific overt act has been attributed against him. Further submission is that petitioner used to reside separate to the husband of the deceased and he has been falsely implicated .

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M. Nalanda at Biharsharif, in Bind P.S. Case No.96 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Rajendra Kumar Mishra, J) AnilKrSinha/- U T
