JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Ex. Trial No. 355 of 2020 arising out of Garkha P.S. Case No. 132 of 2020 instituted for the offences under Sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016. In view of the report received from the learned court below contained in letter no. 1388, dated 21.12.2021, in compliance of the order dated 14.12.2021, the Court for the present is not persuaded to grant bail to the petitioner as the learned court below in its report dated 21.12.2021 has stated that trial is going on day-to-day basis and will be concluded within three months.

No.38339 of 2021(3) dt.11-01-2022 2/2 In the event, the trial is not concluded within a period of three months from the date of receipt of a copy of this order, the petitioner would be enlarged on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran in connection with Ex. Trial No. 355 of 2020 arising out of Garkha P.S. Case No. 132 of 2020.
