JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 17C of 2016 registered under Sections-420, 465, 467, 468/34 of the Indian Penal Code.
The allegation against petitioner No. 1 is that he with the help of petitioner No. 3 transferred some plots of complainant in favour of petitioner No. 2.
Submission on behalf of petitioners is that as a matter of fact, the disputed land belonged to the maternal uncle of petitioner No. 1 and he validly, transferred the same in favour of petitioner No. 3. It is further submitted that even if, prosecution story assumed to be true, then also, it is a case of bona fide land

Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners, named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 17C of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Sheikhpura.
