The petitioner apprehends his arrest in Complaint case No. 1262 of 2015 for the offences allegedly committed by the petitioner under Section 376 and 511 of the Indian Penal Code. The learned counsel for the petitioner submits that the complainant alleged that while she was keeping watch on her maize field the petitioner came and put her down on the ground with an intention to outrage her modesty but the complainant did not support this fact in her deposition on S.A. It is further submitted that Pradip Ram, husband of complainant, and Mahendra Sharma were examined and they disclosed that Tarun Yadav tried to outrage the modesty of the complainant. They did

It is further submitted that prior to institution of this case Pradip Ram, husband of complainant, filed Labour case No. 619 on 11.09.2012 alleging therein that petitioner paid less amount of wages to Pradip Ram. The complainant on account of this dispute for non payment or less payment of wages filed this false case.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Complaint case No.1262 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
