The petitioner seeks bail in connection with Muffasil P.S. Case No. 393 of 2022 registered for the offence under Section 272, 273 of the Indian Penal Code and Section 30(a)(d) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 12.02.2023 and there is recovery of 160 litres of country made liquor from his possession and he has one excise antecedent.

Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of

Patna High Court CR. MISC. No.28272 of 2023(2) dt.15-05-2023 2/2 liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Begusarai in connection with Muffasil P.S.
