ANJANA MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehended their arrest in connection with Muffasil P.S. Case No. 196/2015 registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that actually the present case is one of love marriage between the girl Kumari Nishu and son of petitioner no.6 Munni Devi, wife of Bipin Singh, who had eloped and got married in a village temple. The victim girl Kumari Nishu has also made statement under
Patna High Court Cr.Misc. No.3779 of 2016 (2) dt.12-04-2016 section 164 of the Cr.P.C. stating that she had not been kidnapped and had gone of her own free will with Chandan and married him and none of the family members of Chandan are responsible for the same.
Considering the statement of victim girl, who is said to be a major, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Muffasil P.S. Case No. 196/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) Amit/- U T
