The petitioners apprehend their arrest in connection with Pipra P. S. Case No. 179 of 2016 registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

Allegedly, when the informant with his grand mother and younger brother were returning after offering Puja, the petitioner no. 1 started assaulting the informant with bamboo, thereafter, all the petitioners started assaulting him and snatched Rs. 6500/- and also a gold chain and after causing threats released the informant.

Patna High Court Cr.Misc. No.44427 of 2017(2) dt.21-09-2017 2/2 Submission is of false implication and that the son of the petitioner no. 1 has lodged case bearing Chakiya SC/ST P. S. Case No. 85 of 2016 and as such the petitioners who have been falsely implicated in this case deserve sympathetic consideration.

Learned APP opposes the prayer of pre-arrest bail by submitting that this case has been lodged on 01.11.2016 whereas Chakiya P. S. Case No. 85 of 2016 has been lodged on 23.11.2016 i.e. after 22 days only with a view to put pressure. In the facts and circumstances stated above, this Court is not inclined to grant privilege of pre-arrest bail to the petitioners and accordingly, their such prayer stands rejected.
