The petitioner apprehends his arrest in Kankarbagh P.S. Case No. 808/2015, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. The informant alleged that his daughter was married to Niraj Kumar son of Bishnu Prasad Singh. The informant got information that his daughter was killed by her husband and other family members.

Learned counsel for the petitioner submits that the petitioner is brother-in-law of the deceased. Marriage of the deceased was solemnized more than ten years ago. Petitioner is physically handicapped and he has no manner of concern with the family affairs of the deceased. The deceased got children.

No.41297 of 2016 (3) dt.18-11-2016 2/2 Considering the facts aforesaid and the fact that the petitioner is brother-in-law of the deceased and no specific allegation is made against him, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Patna in connection with Kankarbagh P.S. Case No. 808/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
