The appellant is apprehending his arrest in Prabatta P.S.Case no.234 of 2016 registered under Sections 341, 323, 353, 504, 506/34 of the Indian penal Code and Sections 3(i)(x) of SC/ST Act.

Allegation against the appellant is of abusing the informant by taking his caste name and also assaulted him. Submission of the learned counsel for the appellant is that he has falsely been implicated in this case. No such occurrence has taken place.

Heard Special P.P. also, who has opposed pre arrest bail of the appellant on the ground of maintainability.

Patna High Court CR. APP (SJ) No.2422 of 2017 (2) dt.24-08-2017 2/2 Having heard both the sides and in view of the facts and circumstances of the case, let above named appellant surrender in the court below within four weeks and pray for regular bail, which shall be considered on the basis of materials available on the records or pass such order or orders as he thinks fit and proper.
