Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Kawakol (Rupoh) P.S. Case No. 84 of 2023 registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.03.2023 and he has clean antecedent and due to local village politics, the petitioner has been falsely implicated in this case.

Learned A.P.P. has vehemently opposed the prayer for bail.

From Annexure-II, it appears that the petitioner is suffering from serious kidney ailment and he has been referred to P.M.C.H. for treatment. It has also been mentioned in the Annexure-II that only 27% kidney of the petitioner is working and he is in custody since 22.03.2023. He is not the assailant of the deceased.

Considering the aforesaid facts, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Nawada/concerned Court below in connection with Kawakol (Rupoh) P.S.
