The petitioner seeks anticipatory bail in connection with Amnour P.S.Case No. 103 of 2017, registered for offences punishable under Sections 412, 413, 414, 467, 468, 420/34 of the Indian Penal Code.
Allegation against the petitioner as per the F.I.R. is that the informant along with armed forces proceeded for raid to the house of the petitioner in the night but looking the police party, the petitioner along with other co-accused succeeded to flee away. It is also alleged that a Tata Sumo Gold a Tractor and two motorcycles were also recovered from the door of the petitioner and accordingly seizure list was prepared.
Submission of the learned counsel for the petitioner
Patna High Court Cr.Misc. No.24390 of 2018 (2) dt.09-05-2018 2/2 is that the petitioner has not involved in any offence and he has been falsely implicated in this case and there is a civil dispute among the petitioner and his family members.
Learned A.P.P. opposes the prayer for bail.
Having heard both the parties and in view of the facts and circumstances, this application is disposed of with a direction to the petitioner that if the petitioner surrenders before the court below within a period of four weeks from the date of order and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.
