This application has been filed on behalf of the petitioner for quashing the FIR bearing Madhuban P.S. Case No. 204 of 2016 filed for the offence under Sections 409, 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner wants the quashing of the FIR after considering the defence of the petitioner which is brought on record by way of affidavit which is not permissible in view of the law laid down by the Hon'ble Supreme Court in the case of State of Bihar Vs. P.P. Sharma (1992) Supp (1) SCC 222.

Patna High Court CR. MISC. No.28442 of 2018(9) dt.27-04-2023 2/2 Accordingly, this application is dismissed.

If the investigation is not completed then the police is directed to complete the investigation and file a report within six months from today.
