Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Turkauliya P.S. Case No. 1222 of 2023 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504, 506 and 302 of the Indian Penal Code. 3.

In the nature of allegation as alleged in the FIR, the Court is not inclined to extend the privilege of anticipatory bail to the petitioners as the informant alleges that the accused persons including the petitioners intercepted them and assaulted the deceased brutally, while Surendra also assaulted the informant, further on account of assault, the victim sustained

No.31280 of 2024(4) dt.13-08-2024 2/2 injury and he was sent to hospital where he died during the course of treatment, further from perusal of the order impugned, it manifests that even the post-mortem report of the deceased records that several external injuries were found on the deadbody and the cause of death is mentioned - due to injury and its complications, further the case is in its nascent stages of investigation as such the prayer for anticipatory bail of the petitioners is rejected.

Accordingly, the anticipatory bail application is dismissed.
