The petitioner seeks bail in connection with Bihta P.S. Case No. 262 of 2009 dated 26.09.2019 instituted for the offences under Sections 341, 323, 326, 307, 302 and 34 of the Indian Penal Code. The petitioner along with three others is said to have assaulted the deceased by means of Khanti as a result of which he died. The occurrence is said to have taken place because of dispute over a passage on a piece of land.
It has been submitted on behalf of the petitioner that though he has been named in the FIR but there is no specific accusation against him. He has been made accused in this case because of some dispute
Patna High Court CR. MISC. No.27712 of 2019(4) dt.17-08-2019 2/2 which had been festering from before. The petitioner was not even aware that he has been made accused in this case as he had gone out from his village home to earn his livelihood.
The petitioner is in custody since 05.01.2019. Two of the other accused persons with almost similar allegations have been granted bail by this Court. Considering the aforesaid facts the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur in connection with Bihta P.S. Case No. 262 of 2009.
