JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Bousi P.S. Case No.231 of 2018 registered for the offences punishable under Sections 341, 323, 327, 452, 354(B), 379, 376 and 511 of the Indian Penal Code and Section 24 of CT Act. Allegation as per F.I.R. against the petitioner is of throwing the complainant on land and torn her cloths and also outraging her modesty.
Submission of the learned counsel for the petitioner is that after about one and half months of the occurrence, the complaint case has been registered on the basis of false allegation and the girl is major. Further submission is that petitioner has no criminal antecedent and is in custody since 05.02.2019 and a compromise has been took place between the parties.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Bousi P.S. Case No.231 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
