Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-02-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Sections 302 and 120(B) of the Indian Penal Code, registered in connection with Maharajganj P.S.Case No.311 of 2019.

The informant Madan Prasad lodged the FIR, stating therein that his son Golu Kumar @ Tejaswi Kumar, the deceased was shot dead. Co-accused Ashwini Kumar fired shot on the head of the deceased. In the last portion of the FIR, the informant has expressed his firm belief that the accused persons including the present petitioner were involved in the conspiracy of murder of his son.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.37349 of 2021(2) dt.08-02-2022 2/2 that during investigation the case was not found true against the present petitioner and considering this fact, co-accused Pawan Kumar has been granted anticipatory bail by a coordinate Bench of this Court, vide Cr. Misc.No. 36124 of 2021 under order dated 14.07.2021.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Vth, Siwan in connection with Maharajganj P.S.Case No. 311 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
