Petitioner is apprehending arrest in connection with Gaighat P.S.Case No.275 of 2019 for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case, there is allegation of assault specifically against co-accused Nandlal Sahani and Pradeep Sahani and not against this petitioner and he also submits that the injuries sustained by the informant side is simple.

Considering the fact that the petitioner has no criminal antecedent and there is no allegation of overt-act

No.27624 of 2020(2) dt.25-11-2020 2/2 against the petitioner, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner named above, be released on bail in the event of arrest or surrender before the court below within a period of one month from the date of communication of a copy of this order, on furnishing bail bond of Rs.50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-Ist, Muzaffarpur in connection with Gaighat P.S. Case No.275 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C.
