2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 118(1), 303(2), 324(2), 351(2), 352, 3(5) and 103 of the B.N.S.

3. The case of the prosecution, in short, is that the petitioner along with other ten accused persons started assaulting with lathti-danda. As the informant went to rescue, she was being assaulted by Ajit Kumar with rod. It is further alleged that one Durgesh Rai who was having sword in his hand has assaulted with sword to one Rajendra Rai. Rajendra Rai succumbed to injuries.

Patna High Court CR. MISC. No.28672 of 2026(2) dt.19-06-2026 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that as far as the allegation of assaulting Rajendra Rai is concerned that is specific on Durgesh Rai. The nature of allegation against this petitioner is general and omnibus and that he has not assaulted the deceased rather the allegation is that he along with others has assaulted the informant and her husband. Petitioner is languishing in judicial custody since 08.12.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Saran at Chapra in connection with Dariyapur P.S. Case No. 713 of 2025.
