The petitioner is apprehending his arrest in connection with Karja P.S. Case No. 32 of 2013 for the offences instituted under Sections 467, 468, 471 and 420/34 of the Indian Penal Code.

The prosecution case, in brief, is that all the F.I.R. named accused persons after intoxicating his insane brother Mukesh Kumar Thakur took him to Registry Office and fraudulently got sale deed executed in favour of one Ramesh Kumar Sharma. When the informant came to know about this incident, initially accused persons promised to return the money and a panchayati also took place but even though the said money

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. He has falsely been implicated in the present case. The matter relates to civil dispute. The occurrence is alleged to have been taken place on 07.12.2012 and the case was instituted on 04.03.2013. The delay has not been explained by the prosecution. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Karja P.S. Case No. 32 of 2013 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Tiwari, J.M.1st Class, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
